The regular meeting of the Mayor and Council of the City of Gooding, Idaho was called to order at 7:00 pm in the Gooding Municipal Building, 308 5th Ave West, Gooding, Idaho on December 1, 2014. Pledge of Allegiance was led by Councilman Mel Magnelli.
Present were Mayor Nelson, Councilpersons Arkoosh, France and Magnelli. Councilwoman Houser was not present.
Present were Greg Lamm, MaEllen Lamm, Kayla Worth and Johnathan Canales.
Changes to Agenda (Idaho Code 67-2343 Sec 4 (b))
(Consent Calendar contains items which require formal Council action, but which are typically routine or not of great controversy. Council members can approve the items listed on the consent calendar as one item or, if finding a correction needs to be made, can pull that item for discussion. There will be no separate discussion on these items unless a Council Member or a member of the audience requests removal of the items from the Consent Calendar.)
Mayor Nelson asked, “Consent Calendar Items numbered are before you, are there any items to be removed?” There being no objection, Councilman Arkoosh moved to accept the Consent Calendar as presented. Motion was seconded by Councilman Arkoosh.

Annexation of Rural Fire Department Land: Attorney Craig Hobdey and City Clerk Lierman stated the Notice of the Annexation for the Rural Fire Department Land has been published. The Public Hearing before the Gooding Planning & Zoning Commission will take place on December 10, 2014 at 6:00 p.m. at Gooding City Hall.
Rangen Water Call: Attorney Hobdey stated the City of Gooding’s mitigation plan has been preliminarily approved by the Department of Water Resources and it will go out for publication this week. Rangens have indicated that they will not protest. Another development is the Department of Water Resources have issued a preliminary order issuing a permit to North Snake Ground Water District and Idaho Ground Water Association (IGWA) for 12 CFS out of Billingsley Creek for mitigation for the Rangens fight. Undoubtedly Rangen protested that permit. Rangens will appeal the issuance of this order. If the permit is upheld that would be 12 CFS of mitigation water right there at Rangens sight for the use by Rangens.
FlexTechs: The Council reviewed the contracts with FlexTechs. Councilman France moved to postpone the FlexTechs agreement until the December 15, 2014 meeting. Motion seconded by Councilman Magnelli. Motion carried unanimously.
Ordinance No. 690: Attorney Hobdey stated in July 2013 we sent Ordinance No. 681 to Sterling Codifiers. Attorney Hobdey stated that he did not create Ordinance No. 681. Ordinance No. 681 is incorrect and it cannot be codified. Attorney Hobdey made the necessary changes to make Ordinance No. 681 correct. Ordinance No. 690 states, An ordinance of the City of Gooding, State of Idaho, a Municipal Corporation, amending Gooding City Ordinance No. 681, specifically amending section 2, thereof by substituting the following and repealing all ordinances in conflict therewith. Public Works Director Todd Bunn stated that since they have put up cement barriers on 9th Ave West, they have not had any problems and enforcing a one-way street would be difficult. Attorney Hobdey stated that we could repeal Ordinance 681 altogether. The Council agreed to repeal Ordinance No. 681.
Police Chief Chris Ward: Police Chief Chris Ward was not present.
Fire Chief Brandon Covey: Fire Chief Brandon Covey was not present.
Public Works Director Todd Bunn: PWD Bunn reminded everyone about the skate park meeting at the Gooding County Fairgrounds at 7:00 pm tomorrow night. PWD Bunn requested that on December 24, 2014 that the City Office close at 3:00 pm for Christmas. Councilman Arkoosh made a motion to close the City Offices close at 3:00 pm on December 24, 2014. Motion seconded by Councilman France. Motion carried unanimously. PWD Bunn also stated the monitoring wells are up and running and they have pulled samples from both wells.
City Clerk Hollye Lierman: City Clerk Hollye Lierman submitted letters and notices of interest to the Council.
Library Director Cindy Bigler: Library Director Cindy Bigler stated the Library had 1693 patrons; they were open 117 hours and 632 patrons for computer usage. She said that was down from the previous month and feels that it is due to the server shutting down. City Clerk Hollye Lierman stated that FlexTechs would like to put the Library on their own server. Cindy stated that having their own server might be the only way to fix the problem because they draw a lot of usage between the Wi-Fi and the number of computers being used at one period of time. We do not have enough broadband in our community for the amount of people who are running the internet whether it is 3G, 4G or home computers and you can only pull so much out of the broadband.
